પોર્ન ફિલ્મો બનાવવાના આરોપમાં મુંબઈ ક્રાઈમ બ્રાંચએ એક્ટ્રેસ શિલ્પા શેટ્ટીના પતિ અને વેપારી રાજ કુંદ્રાની ધરપકડ કરી છે. મંગળવારે તેને કોર્ટમાં હાજર કરાશી. હવે નિર્ણય કોર્ટની ઉપર છે કે કુંદ્રાને રિમાંડ પર મોકલવુ છે કે જામીન આપવી છે. આવા કેસમાં મોટા ભાગે આરોપીઓની સામે આઈટી એક્ટ અને ઈંડિયન પીનલ કોડ (IPC) ની ધારા હેઠણ કેસ દાખલ કરાશે. જો કોર્ટ રાજ કુંદ્રાને દોષી ઠરાવે છે, તો તેણે કેટલા વર્ષ જેલમાં પસાર કરવી  પડશે આવો જાણીએ અમારા દેશમાં પોનોગ્રાફી અને પોનોગ્રીફિક કંટેટના કેસમાં કાનૂન ખૂબ સખ્ત છે. ઈંટરનેટના પ્રસાર પછી આઈટી એક્ટ સંશોધન કરાયુ હતું. જેથી અત્યારે સમયમાં એવ કેસમાં દોષીઓને સખ્ત થી સખ્ત સજા મળી શકે. 
 
એંટી પોર્નિગ્રાફી કાયદો 
ઈંટરનેટના સમયમાં પોર્નિગ્રાફીનો વેપાર ખૂબ વધ્યુ છે. અશ્લીલતના વેપારનો વિસ્તાર ન્યૂડ ફોટા, વીડિયો, ટેકસ્ટ, ઑડિયો જેવા મટેરિયલથી તીવ્રતાથી વધી રહ્યુ છે. એવા મટેરિયલને ઈલિક્ટ્રોનિકના માધ્યમથી પ્રકાશિત કરવા, કોઈને મોકલવા કે પછી કોઈનાથી પબ્લિશ કરાવવા પર એંટી પોર્નિગ્રાફી કાયદા હેઠણ કેસ નોંધવામાં આવ્યો છે. 
 
પોર્નિગ્રાફી મોકલવી કે પબ્લિશ કરવુ અવૈધ 
બીજાનો અશ્લીલ વીડિયો બનાવવુ અને તેને બનાવીને ઈલેક્ટ્રોનિક માધ્યમોથી બીજા સુધી પહોચાડતા એંટી પોર્નોગ્રાફી કાયદાની સીમામાં આવે છે. સાથે જ કોઈને તેમની મરજી વગર અશ્લીલ કંટેટ મોકલતા પર પણ આ કાયદો લાગે છે. પોર્નોગ્રાફી પ્રકાશિત કરવી કે કોઈને મોકલવી અવૈધ છે.  પણ તેને જોવુ, સાંભળવુ અને વાંચત પર કોઈ રોક નથી. પણ ચાઈલ્ડ પોર્નિગ્રાફી જોવુ પણ અવૈધ છે. આવુ કરનારને જેલની સજા ભોગવી પડી શકે છે. 
 
કેટલી થઈ શકે છે સજા 
પોર્નિગ્રાફીના હેઠણ આવનાર કેસમાં આઈટી કાયદા 2008ની ધારા 67 (A) અને આઈપીની ધારા  292, 293, 294, 500, 506 અને  509ના હેઠણ સજાનો પ્રોવીઝન છે. અપરાધની ગંભીરતાના મુજબ પ્રથમ ભૂલ 5 વર્ષ સુધી જેલ કે 10 લાખ રૂપિયા સુધીનો દંડ લાગી શકે છે. પણ બીજી વાર એવા દોષમાં પકડવા પર જેલની સજા વધીને સાત વર્ષ સુધી થઈ શકે છે. 
 
પોલીસ શું કહે છે
મુંબઈ પોલીસ સૂત્રો પાસેથી પ્રાપ્ત માહિતી અનુસાર રાજ કુંદ્રાએ આ ઉદ્યોગમાં (પોર્ન ફિલ્મોનો ઉદ્યોગ) આશરે 8 થી 10 કરોડનું રોકાણ કર્યું હતું. રાજ કુંદ્રા અને તેનો ભાઈ બ્રિટનમાં રહે છે. સાથે મળીને એક કંપનીની રચના થઈ, જેનું નામ કેનરીન છે. આ વીડિયો ભારતમાં શૂટ કરવામાં આવ્યા હતા અને ત્યારબાદ વી ટ્રાન્સફર દ્વારા યુકેમાં સ્થાનાંતરિત કરવામાં આવ્યા હતા.
